Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth the terms and conditions for the use of our services. For the purpose of this Policy, “VapourHost”, “we”, “us” and “our” refer to VapourHost Private Limited and its affiliates, its services (the “Services”) and its websites. “You”, “your” and “customer” refer to you, the user of our services, or any entity, organisation, company or person authorised to act on your behalf.

The examples named in this Policy are non-exclusive. VapourHost reserves the right to modify this Policy at any time, effective immediately when posted on the website. By accessing the site or using our services, you agree to the latest version of this Policy.

VapourHost reserves the right to refuse service to anyone. Failure to respond to our abuse emails within the time specified in the email, and in any case within 48 hours, may result in suspension or termination of your service.

1.0 Resource Abuse

1.1 Your service shall not be used for any activity, intentional or otherwise, that consumes enough server resources to negatively affect the performance of the server or other clients or websites on the server. Use of your service shall not endanger the operation of the server.

1.2 You and your service shall not:

run stand-alone, unattached server-side processes or daemons
violate the laws of India or of the country in which the server hosting your service is located
host any malicious content, intentionally or otherwise
run or participate in any P2P (peer-to-peer) activities
run cryptocurrency mining, or operate a file storage, download or mirror site

2.0 Emails and Anti-spam Policy

2.1 We ("VapourHost") take spam issues very seriously and have zero tolerance for the use of our service for any activity which can be termed as SPAM, intentional or otherwise. This includes any email-based communication sent without the consent of the recipient and the sending of unsolicited email, bulk email and spam.

2.2 Any complaint we ("VapourHost") receive about a violation of our policy or the preceding point will be taken very seriously and will result in immediate account cancellation without a refund.

2.3 VapourHost reserves all rights to suspend or terminate any service which is detected to be sending spam.

2.4 VapourHost reserves all rights to charge the account holder of a service sending spam a fee for damages incurred, to compensate us for the increased administration costs and expenses of redressing SPAM-related activity.

2.5 We ("VapourHost") also strictly prohibit the following activities:

Forgery of email headers ("spoofing")
Using your service to allow and process third-party emails
Any activity which violates the CAN-SPAM Act of 2003

3.0 Unacceptable Content or Material

3.1 You are not permitted to host any content which may negatively affect any user, person or organisation.

3.2 You are not permitted to host any material or content which promotes any kind of spam, violence, gambling, torrent portals or any other illegal activity.

3.3 Your service shall not be used to distribute or contain nudity, pornography, hateful content towards any religious, social or ethnic group, or programs which may damage or affect the operation of anyone's property, such as malware, Trojan horses, worms and viruses.

3.4 Any activity, content or material which violates the laws of any applicable national, state or local government is also strictly prohibited.

4.0 Resource Usage Policy

4.1 Your services, including any hosting package, may not:

Use more than 25% of the total resources allotted to the service. This includes, but is not limited to, CPU time and memory.
Burst beyond these resources for longer than 120 seconds in any given week (7 days).
Run any cron job with an interval of less than 15 minutes.
Generate slow queries for more than 1% of a service's or database's queries on any given day (queries which run for more than 1 second are considered slow).
Affect the overall performance of the server, including, but not limited to, regular backups, I/O wait or any other service-related issue.

4.2 Disk and traffic usage policy:

All the disk space and traffic allotted to a service is solely for serving the websites and applications hosted on it over the internet. Using disk space or traffic for any other activity is prohibited. This includes, but is not limited to, making backups or storing data other than the hosted applications.
The one and only exception to this disk policy is storing a single backup of the same hosting account.

5.0 Backup Policy and Limitations

5.1 We ("VapourHost") take complete daily off-site backups of our shared hosting services (the Basic, Primary and Power plans) on a best-effort basis, and backups can be restored free of charge through a support ticket. We shall not be held responsible for these backups. The customer acknowledges that our backup service has limitations, both technical and economic.

5.2 Customers are responsible for keeping their own backups of their data and for regular maintenance. A backup of a service may fail due to various technical problems, and we hold no responsibility for it.

5.3 To be eligible for the backup service, an account or service must not use more than 25 GB of disk space and/or more than 200,000 inodes. Customers can discuss a fee for any service exceeding these limits to remain eligible for backups.
